Claims Examiner Certification Program

 
The Workers' Compensation Division requires claims examiners be certified in order to process Oregon worker compensation claims. To ensure compliance with these rules, the director may impose civil penalties against an insurer, self-insured employer, or third-party administrator for failure to maintain and produce certification and continuing education records.

Insurers, self-insured employers, and third-party administrators may only employ certified claims examiners, qualifying claims examiner trainees, or temporary claims examiners to process workers' compensation claims.

Currently, OAR 436-055-0070 requires a certified examiner to earn 24 continuing education credits every three years. At least four hours of the training must be on the workers' compensation statutes, administrative rules or case law, and for renewals on or after January 1, 2007, three hours of training must be related to interactions with independent medical providers.

Any training related to interactions with independent medical examination providers must first be approved by the director. Anyone may develop training and receive approval by the director. The application must describe the training content that meets the criteria in OAR 436-055-0085(2), and specify the number of training hours.
