Health insurance portability & accountability act (HIPAA)

The State of Oregon is committed to a patient’s right to have protected health information (PHI) safeguarded from unlawful use or disclosure and the individual's right to access and review their information. HB 2305 effective on May 24, 2003 explains the state’s policy and the additional rights and obligations provided by the Health Insurance Portability & Accountability Act (HIPAA).

The Health Insurance Portability and Accountability Act (HIPAA) enacted by the Federal government includes Title II Administrative Simplification. Title II is intended to improve the efficiency and effectiveness of the health care system by encouraging the development of standards for electronic transmission, privacy, and security of certain health information.


The Workers’ Compensation Division is committed to the principles of improving the efficiency and effectiveness of the health care system. ORS 192.502(2)(19) and OAR 436-060-0009 covers access to workers’ compensation records of the Department of Consumer and Business Services.
